12 January 2009 As he was in 2006, 2007 and 2008, Gary Leydig has been named an Illinois “Super Lawyer” by Law & Politics Publications. 15 December 2008 Having been earlier stymied by the district court in his effort on behalf of a local Girl Scout council to prevent the arbitrary taking of its territory by the national Girl Scout organization, the Seventh Circuit Court of Appeals today handed down its opinion in support of an interlocutory order of preliminary injunction against the Girl Scouts of the USA. The opinion is the first of its kind in the nation to hold that nonprofit organizations are as subject to a state’s franchise and dealership laws as are their for-profit counterparts. The case has received considerable attention in both the legal and mainstream press. Click here to read commentary by the State Bar of Wisconsin. 8 March 2007 The lead article run by Forkliftaction.com highlighted Gary Leydig's efforts and successes in protecting the rights of lift truck dealers across the country. Commenting on the 8th Circuit Court of Appeal’s affirmance of the wrongful dealership termination case tried by Mr. Leydig in 2003, Gary was quoted as saying: “I hope the appellate court’s recent decisions and orders will cause Raymond [the manufacturer found guilty of wrongfully terminating its dealer and who blamed the outcome on a bad legal system], and others who think like Raymond, to reconsider the obviously self-serving and wrongheaded outlook on the greatest and fairest legal system in the world. A large part of my practice involves representing dealers. Many dealers are unaware that these and similar statutes exist for their protection. I hope this case educates dealers about their potential rights and causes manufacturers to draft fairer contracts and treat their dealers with the good faith and fairness these statutes require.” To read the full article, click here.

28 December 2006 The United States Circuit Court of Appeals for the 8th Circuit today rendered a decision affirming a judgment against The Raymond Corporation (a member of the Toyota Industries family of companies) in the amount of $12,729,767. The appeal arose out of a suit brought by Gary Leydig on behalf of Minnesota Supply Company, claiming that Minnesota Supply had been wrongfully terminated as Raymond’s dealer in Minnesota, North and South Dakota, and portions of Wisconsin. In 2003, a jury found, and the Eighth Circuit today affirmed, that Raymond had wrongfully terminated its former dealer, Minnesota Supply Company, in violation of a Minnesota statute that, among other things, prohibits a manufacturer from terminating industrial equipment dealers without good cause. The Circuit Court today also remanded the case back to the United States District Court for the District of Minnesota for the recalculation of the total attorneys’ fees and expenses that should be awarded to Minnesota Supply as a result of the Circuit Court’s decision. Fees and expenses incurred by Minnesota Supply through the end of the trial in 2003, in an amount in excess of $740,000, had already been awarded by the trial court to Minnesota Supply prior to today’s ruling.
